Okibura Members Terms of Use

Article 1: Application of These Terms and Conditions

These Terms and Conditions set forth the terms of use for the membership service “Okibura Members” (hereinafter referred to as “the Service”) provided by Okibura (hereinafter referred to as “this Site”).
By registering as a member of this Service, users are deemed to have agreed to all the terms and conditions set forth in these Terms of Service. If you do not agree to any provision of these Terms of Service, you may not use this Service. If you do not agree with the terms of these Terms of Service, we strongly recommend that you refrain from using this Service.
The use of this service is also subject to the “Okibura Privacy Policy,” which is set forth separately. In the event of any conflict between these Terms of Service and the Privacy Policy, the provisions of these Terms of Service shall prevail.

Article 2: Design That Does Not Collect Members' Personal Information

This site employs a method that does not collect any personally identifiable information—such as a member’s real name, email address, phone number, or other similar information—during the membership registration process for this service.
This is a design policy intended to minimize, as much as possible, the potential inconvenience to members in the unlikely event that a system malfunction or security issue occurs on this site.
As a result of this design policy, this site has no means of verifying a member’s identity—based on information such as their name, email address, or phone number—or restoring their data in the event that a member loses their LINE account or their member data is lost for any reason. Members must use this service with the understanding of this design policy and the provisions set forth in Articles 5 and 10.
For details on the specific scope of information collected by this site, please refer to Article 3-2 of the “Okibura Privacy Policy,” which is set forth separately.

Article 3 Definitions
━━━━━━━━━━━━━━━━━━━
The definitions of terms used in these Terms and Conditions are as follows.
"Member" refers to a user who has agreed to these Terms and Conditions and has completed the membership registration process in accordance with the method specified in Article 4.
"Member Benefits" is a general term referring to features available exclusively to members, such as My List, quizzes, personality tests, packing lists, and others.
"Point Level (Lv)" refers to the system set forth in Article 7, under which points are awarded to members based on their activity within this Service.

Article 4: Member Registration
━━━━━━━━━━━━━━━━━━━━━━━━━━━━
[4-1] How to Register
User registration shall be conducted through “LINE Login,” a service provided by LINE Corporation. For details regarding the scope of information collected during registration and how it is handled, please refer to Article 3-2 of the “Okibura Privacy Policy,” which is set forth separately.
[4-2] Use by Minors
Minors may use this Service only with the consent of a parent or guardian. Even if a minor uses this Service without the consent of a parent or guardian, such use shall be deemed to have been made with the consent of a parent or guardian.
[4-3] Refusal of Registration
This site may refuse membership registration in any of the following cases:
・If the registration information contains false information
・If you have previously been subject to measures such as suspension of service due to a violation of these Terms of Service
・In addition, in cases where this site determines that registration is inappropriate

Article 5: Responsibility for Member Management
━━━━━━━━━━━━━━━━━━━
[5-1] Members shall be solely responsible for managing their own LINE accounts.
[5-2] Any use of this Service through a Member’s LINE account shall be deemed to be use by the Member themselves. This Site shall not be liable for any damages incurred by a Member due to unauthorized use of their LINE account or similar circumstances, except in cases where this Site is found to have acted with intent or gross negligence.
[5-3] Members shall promptly update their registration information (such as their nickname) using the features within this Service if there are any changes to such information.
[5-4] If a member deactivates or deletes their LINE account and creates a new one, that new LINE account will be treated by our site’s system as a new member separate from the previous account. This site has no means of linking the previous member’s data (including points, level, favorites, and quiz history) to the new LINE account, and under no circumstances can this data be restored.
Please note that if you use the “Account Transfer” feature provided by LINE when changing your smartphone model or for other reasons, your LINE account will remain the same, so your member data will be retained as is. However, regardless of whether the loss of member data is due to a device change, account transfer, or any other reason, this site cannot investigate the cause, restore the data, or take any other corrective action.

Article 6: Details of Member Benefits

[6-1] Members can use the following features on this Service.
・My List (Save articles and spots as favorites)
・View Quiz History
・Reviewing the results of the dependency assessment
・Managing a packing list
・Other member-only features that this site will add in the future
[6-2] This site reserves the right to add, modify, or discontinue member benefits at its discretion without prior notice. This site shall not be liable for any disadvantages incurred by members as a result of changes to member benefits.

Article 7: Points and Level (Lv) System
━━━━━━━━━━━━━━━━━━━
[7-1] Overview of the System
This site offers a system that awards points based on members' activities within the service (such as logging in, adding items to favorites, participating in quizzes, completing assessments, and viewing articles), and determines their level (Lv) based on their total points.
[7-2] The Legal Nature of Points and Levels
Points and Levels are indicators of a member’s activity within this service and have no monetary value. Members have no right to request that this site grant, maintain, or pay out Points or Levels.
[7-3] Future Usability
This site may, in the future, link points and levels to rewards, coupons, products, or other services. However, such a link has not been finalized at this time. The terms and conditions for any such link will be determined separately by this site.
[7-4] Deletion and Reset
This site may delete or reset all or part of a member's points or level in any of the following cases:
・If a member cancels their membership
・If a member has not logged in to the Service for an extended period (as separately specified by this site)
・If this site determines that points were obtained through fraudulent means
・In addition, in any other cases where this site deems it necessary for the operation of this program
[7-5] This site may change the methods for calculating points and levels, as well as the conditions for awarding them, without prior notice due to changes in system specifications, bug fixes, or other reasons.

Article 8: Prohibited Acts
━━━━━━━━━━━━━━━━━━━
When using this Service, Members must not engage in the following acts.
Acts that violate laws and regulations or public order and morality
Any act that infringes upon the intellectual property rights, portrait rights, privacy, or other rights of this site or a third party
Defamation, harassment, or other disruptive behavior toward other members or third parties
Acts of obtaining points or levels through fraudulent means, or attempting to do so
Unauthorized access to, analysis of, or tampering with the system for this service, or any other similar acts
The unauthorized creation or use of multiple member accounts
Using this service by impersonating another person
Acts that interfere with or are likely to interfere with the operation of this service
Any other conduct that this site deems inappropriate

Article 9: Measures Such as Suspension of Use and Cancellation of Registration

[9-1] If this Site determines that a member falls under any of the following categories, it may, without prior notice, suspend the member’s use of all or part of the Service, cancel the member’s registration, or take any other measures deemed necessary by this Site.
In the event of a violation of the prohibited acts set forth in Article 8
If it is determined that the registration information contains false information
In the event of a violation of any provision of these Terms
In addition, if this site determines that a user is unsuitable as a member
[9-2] This Site shall not be liable for any damages incurred by members as a result of the measures described in the preceding paragraph, except in cases where this Site has acted with intent or gross negligence.
[9-3] If the measures described in the preceding paragraph are taken, all benefits related to points, membership levels, and other membership perks held by the member in question shall be forfeited, and the member may not make any claims against this site for their restoration or otherwise.

Article 10: Withdrawal from Membership
━━━━━━━━━━━━━━━━━━━
[10-1] Members may cancel their subscription to this Service at any time by following the procedures specified by this site.
[10-2] Points, levels, favorites, and other member data for members who have canceled their membership will be deleted, and we do not support the restoration of such data after cancellation.
[10-3] Even if you re-register as a member after canceling your membership, your points, level, and other membership data from before cancellation will not be carried over.

Article 11: Suspension, Modification, or Termination of the Service

[11-1] This site may suspend or interrupt the provision of all or part of the Service without prior notice to members in any of the following cases:
When performing system maintenance, inspection, or updates
In the event that it becomes difficult to provide this service due to force majeure, such as earthquakes, lightning strikes, fires, power outages, or natural disasters, etc.
If it becomes difficult to provide this Service due to system failures, unauthorized access, cyberattacks, or other reasons
In addition, if this site determines that it is difficult to provide this service
[11-2] This site reserves the right to modify the content of this service or terminate the provision of this service at its discretion. In the event that this service is terminated, this site will provide advance notice on this site to the extent possible.
[11-3] This Site shall not be liable for any damages incurred by a Member as a result of measures taken by this Site pursuant to this Article, except in cases where this Site has acted with intent or gross negligence.

Article 12 Intellectual Property Rights

All intellectual property rights related to the text, images, systems, and other content provided by this site in connection with this service belong to this site or to third parties who hold legitimate rights thereto. Members may not reproduce, reprint, modify, redistribute, or otherwise use such content without the prior permission of this site.
Please note that the handling of copyrights and citations regarding the article content provided on this site is governed by the provisions of Article 10 of the separately established “Okibura Privacy Policy.”

Article 13: Disclaimer of Warranties and Limitation of Liability

[13-1] This site makes no warranties, express or implied, regarding the suitability of this Service for any specific purpose of the Member, its expected functionality, accuracy, or usefulness, the compliance of the Member’s use of this Service with applicable laws and regulations, or the absence of defects.
[13-2] This site assumes no liability whatsoever for any damages incurred by members as a result of this service, except in cases of willful misconduct or gross negligence on the part of this site.

Article 14: Amendments to These Terms and Conditions

This Site reserves the right to amend these Terms and Conditions without notice to members whenever it deems necessary. The amended Terms and Conditions shall take effect upon their posting on this Site, and if a member uses the Service after such amendment, that member shall be deemed to have agreed to the amended Terms and Conditions.

Article 15: Communication and Notices

Communications and notifications from this Site to members regarding this Service shall be made through displays within this Service, messages via the official LINE account, or any other method deemed appropriate by this Site.

Article 16: Prohibition on Assignment of Rights and Obligations

Members may not assign, lend, pledge as collateral, or otherwise dispose of their rights or obligations under these Terms to any third party without the prior written consent (including via email) of this Site.

Article 17: Severability

Even if any provision or part thereof of these Terms is deemed invalid or unenforceable under laws, regulations, or other applicable rules, the remaining provisions of these Terms and the remaining parts of the provision deemed invalid or unenforceable shall remain in full force and effect.

Article 18: Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. In the event of any dispute arising between this Site and a Member in connection with this Service, the courts having jurisdiction over the location of this Site shall have exclusive agreed jurisdiction as the court of first instance.
